Acceptance of Terms
VorkBid is operated by Alkasid ("Alkasid", "we", "us", or "our"). These Terms of Service govern your access to and use of the VorkBid marketplace, including all listings, auctions, purchases, and related services. By creating an account, listing an item, placing a bid, or otherwise using VorkBid, you agree to be bound by these terms.
If you do not agree to these terms, you may not use the platform. If you are using VorkBid on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Our Role as a Marketplace
VorkBid provides an online venue that connects buyers and sellers of vehicles, equipment, and related goods. The contract of sale for any item is formed directly between the buyer and the seller. VorkBid is not a party to that contract, is not the buyer or seller of any item, and does not take title to, inspect, or take possession of listed items.
VorkBid is not a bank, money-services business, payment processor, or escrow agent, and does not hold or transmit user funds. We provide tools to coordinate bidding, payment instructions, and delivery, but the responsibility for completing a transaction, including sending and receiving payment and handing over goods, rests with the buyer and seller.
Account Registration
You must register an account to buy or sell on VorkBid. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for all activity that occurs under your account.
You must be at least 18 years old and legally able to enter into binding contracts. You are responsible for maintaining the confidentiality of your login credentials and for notifying us immediately of any unauthorized use of your account.
We may require identity verification before you can list items, place bids above certain thresholds, or withdraw funds. We may suspend or terminate accounts that provide false information or that we reasonably believe are being used for fraudulent or unlawful purposes.
Auction Rules
When you place a bid in an auction, you make a binding offer to purchase the item at the bid amount. Bids cannot be retracted once placed. The highest valid bid at the close of the auction wins, provided any reserve price has been met.
Sellers may set a reserve price, the minimum amount they will accept. If bidding does not reach the reserve, the item will not be sold. Reserve prices are not disclosed to bidders.
Shill bidding, which means bidding on your own listing or arranging for others to inflate bids, is strictly prohibited. We monitor bidding activity and will cancel bids, remove listings, and suspend accounts engaged in bid manipulation.
Instant Buy Terms
Certain listings offer an instant-buy option, allowing you to purchase an item immediately at a fixed price without waiting for an auction to close. Selecting instant buy creates a binding contract of sale.
Once an instant-buy purchase is confirmed, the listing is closed and the item is reserved for you. Payment obligations apply immediately and are governed by the payment terms below.
Payment Terms
Buyers must complete payment within the payment window shown on the order after winning an auction or confirming an instant-buy purchase. Failure to pay within this window may result in cancellation of the sale, relisting of the item, and suspension of your account.
VorkBid is a marketplace venue, not a bank, payment processor, or escrow agent. Payment is arranged and made directly between the buyer and the seller using the bank-transfer instructions provided on the platform for the order. VorkBid does not take custody of, hold, or transmit buyer funds, and does not guarantee that any payment will be made or received.
Buyers and sellers each confirm the payment on the platform once it has been sent and received. You are responsible for any taxes, duties, or import fees that apply to your purchase, and for verifying payment details before sending any funds.
Fees and Commissions
VorkBid charges a buyer premium of 7% of the winning bid or instant-buy price, added to the amount the buyer pays, and a seller fee of 7% of the sale price, deducted from the seller proceeds. The applicable amounts are shown on the order before the sale is completed.
Additional fees may apply for optional services such as featured placement or pinned listings. All applicable fees are disclosed before you incur them. We may change our fees from time to time and will provide notice of material changes.
Seller Obligations
Sellers must accurately and completely describe each item, including its condition, provenance, authenticity, and any defects. Photographs must depict the actual item being sold. Misrepresentation is grounds for cancellation, refund, and account suspension.
You may only list items you own and have the legal right to sell. Upon a completed sale, you must make the item available through the delivery method chosen for the order (self-pickup, self-arranged delivery, or a platform carrier) within the timeframe agreed for that method, with appropriate packaging.
Sellers are responsible for ensuring that items comply with all applicable laws and that any required export or import documentation is provided.
Buyer Obligations
Buyers must pay for items they win or purchase within the payment window shown on the order, as set out in the payment terms. By bidding or buying, you confirm your intention and ability to complete the purchase.
Upon delivery, buyers should promptly inspect the item to confirm it matches the listing description. If there is a discrepancy, you must raise a dispute within the dispute window described below.
Prohibited Items
You may not list or sell items that are stolen, counterfeit, or fraudulent; weapons, firearms, or ammunition; hazardous or illegal materials; protected wildlife or restricted cultural property; or any item whose sale is prohibited by applicable law.
We may remove any listing that violates these restrictions, cancel related transactions, and report unlawful activity to the appropriate authorities. Repeated or serious violations will result in permanent account termination.
Dispute Resolution
If an item is not as described or does not arrive, buyers may open a dispute within 14 days of delivery or expected delivery. We will review the evidence provided by both parties and mediate in good faith.
Because payment is made directly between buyer and seller and VorkBid does not hold funds, any refund or return must be carried out by the parties themselves; VorkBid cannot reverse a payment or guarantee a refund. Our role is to mediate, and we may take account action against a party who acts in bad faith, including suspension or removal from the platform.
Limitation of Liability
VorkBid provides the marketplace and related services with reasonable care but does not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, VorkBid is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data.
Our total liability arising out of or relating to your use of the platform is limited to the fees we received from you in connection with the transaction giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law.
Intellectual Property
The VorkBid name, logo, platform, and all related content and software are owned by Alkasid and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
By submitting listings, photographs, or other content, you grant VorkBid a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content for the purpose of operating and promoting the marketplace.
Termination
You may close your account at any time, subject to the completion of any open transactions and obligations. We may suspend or terminate your access to VorkBid if you violate these terms, engage in fraudulent or harmful conduct, or where required by law.
Upon termination, provisions that by their nature should survive, including those relating to payment, fees, liability, intellectual property, and dispute resolution, will continue to apply.
Governing Law
These terms are governed by and construed in accordance with the laws of the jurisdiction in which Alkasid is registered, without regard to its conflict-of-laws principles.
Any dispute that is not resolved through our internal dispute-resolution process will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless applicable law requires otherwise.
